Terms of Service
These terms are the agreement between you and Alejandro Garza for the use of Rickey — the website and the app. They are written in plain language on purpose. Using Rickey means you accept them.
Last updated: 2026-08-25
The agreement
This agreement is between you and Alejandro Garza ("we", "us"), based in Mexico. It covers the Rickey mobile app, the rickey.app website, and any related service we provide (together, "the Service").
If you do not agree with these terms, do not use the Service. If you are accepting them on behalf of an organisation, you confirm you are authorised to bind it.
Who can use it
You must be at least 13 years old to use Rickey, and at least 16 in countries where local law sets that as the minimum age to consent to online services on your own behalf. You must not be barred from using the Service under the laws of your country or of Mexico.
You are responsible for everything that happens under your account, including keeping your password to yourself. Tell us at hola@buildpassing.com if you believe someone else has access to it.
Your licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Rickey on devices you own or control, for your own personal, non-commercial use, in accordance with the usage rules of the app store you obtained it from.
This is a licence, not a sale. We keep all rights in the Service that we do not expressly grant you here.
What you must not do
You agree not to:
- Break the law using the Service, or use it to help anyone else break the law.
- Upload content that is unlawful, that infringes someone else’s rights, or that is designed to harass or harm a person.
- Attempt to gain access to accounts or data that are not yours.
- Reverse engineer, decompile or disassemble the app, except where that restriction is prohibited by law.
- Interfere with the Service’s operation — including by overloading it, circumventing rate limits, or probing it for vulnerabilities without our written permission.
- Resell, rent out or commercially redistribute the Service.
- Scrape or bulk-extract data from the Service by automated means.
We may suspend or terminate an account that breaks these rules. Where it is reasonable, we will warn you first and give you a chance to put it right.
Alcohol, age and what this app is not
Rickey is a measured reference for people who already drink. It exists to tell you what you can make from the bottles you already own, and to get the measures and the order right.
- You must be at least 18 to use it, or older where the legal drinking age where you live is higher. The app is age-rated accordingly on both stores.
- We do not sell, supply or deliver alcohol, and we are not connected to any retailer, bar or brand. Nothing in the app is a purchase.
- Nothing in the app is medical, dietary or health advice. Alcohol affects people differently and interacts with medication and with conditions we know nothing about.
- Recipes are written for one drink at a stated strength. Scaling a recipe scales the alcohol in it, which is worth remembering when the app offers to batch for forty.
- What you do with a recipe is yours to decide. We do not moralise about it, and we also do not pretend the drinks are anything other than alcoholic.
Do not drive after drinking, and do not rely on Rickey to tell you whether you are fit to. It counts measures, not people.
Your content
Your shelf, your saved drinks, your notes and your bar book are yours. We claim no ownership of them.
You grant us a licence to host, store, transmit, back up and display that content solely in order to run the Service for you. That licence is limited to that purpose, is not exclusive, and ends when you delete the content — subject to the backup retention periods described in the Privacy Policy.
Rickey has no sharing feature, so nothing you enter is visible to another user. Do not put anything in one that you would not want the people you live with to read.
You confirm you have the right to upload what you upload. We may remove content that breaks these terms or the law, and we may do so without notice where it is seriously harmful.
What it costs
Nothing. Every feature of Rickey is free, for everyone: your whole shelf, every recipe, the step-by-step pour, the shopping list, unlimited saves, batch and party maths, host mode, substitutions and the bar book.
- There is no paid tier, no subscription and no in-app purchase. Nothing in the app can take a payment, because there is no purchase surface in it at all.
- There is no trial that ends and no feature that stops working. Nothing you make or save is held behind a payment.
- We never see your card details, because there is never a card. No payment of any kind passes through us.
- An account is optional and free. It exists so a second phone does not lose your shelf, not to unlock anything.
This section used to describe Rickey Pro — a one-time purchase covering batch maths, host mode, the bar book and unlimited saves. That product does not exist and is not planned. Every feature it named is in the app now, free, and the section is rewritten rather than deleted so anyone who read the old terms can see what changed.
Availability and changes
We work to keep the Service running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features. Where a change materially removes a feature you rely on, we will give you reasonable notice. There is nothing to refund, because there is nothing to buy.
If we ever discontinue Rickey entirely, we will give at least 60 days' notice and provide a way to export your data before it is shut down.
Ending the agreement
You can stop using Rickey at any time and delete your account from within the app, or through /delete-account. Deleting your account ends this agreement.
We may suspend or terminate your access if you materially breach these terms, if we are required to by law, or if continuing to provide the Service to you would expose us or another user to real risk. Except where the breach is serious or unlawful, we will tell you why and give you a reasonable opportunity to fix it.
Warranties and disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
Nothing in these terms excludes or limits any right you have that cannot be excluded or limited under the law that applies to you — including consumer guarantees under Mexican consumer law, the EU Consumer Rights Directive, the UK Consumer Rights Act, or equivalent legislation. Where any part of this section conflicts with such a right, that right prevails.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data or lost goodwill, arising out of your use of the Service.
Our total liability arising out of or relating to the Service is limited to USD $50. This used to read "the greater of what you paid us in the last 12 months, or USD $50". You never pay us anything, so the first limb was always zero and the clause always resolved to the second — it is written plainly now rather than appearing to offer a calculation that has no inputs.
We do not exclude liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
Additional terms for the Apple App Store
This section applies where you obtained Rickey from the Apple App Store. It is required by Apple, and in case of conflict it prevails over the rest of these terms for App Store users.
- Acknowledgement
- This agreement is between you and Alejandro Garza only, and not with Apple. We, not Apple, are solely responsible for the app and its content.
- Scope of licence
- The licence granted to you is limited to a non-transferable licence to use the app on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support
- We are solely responsible for providing maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty
- We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- Product claims
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Intellectual property claims
- In the event of a third-party claim that the app infringes that party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms
- You must comply with any applicable third-party terms of agreement when using the app — for example, your wireless data service agreement.
- Third-party beneficiary
- Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
- Developer contact
- Questions, complaints or claims: hola@buildpassing.com.
Additional terms for Google Play
Where you obtained Rickey from Google Play, your use is also subject to the Google Play Terms of Service. This agreement is between you and Alejandro Garza only; Google is not a party to it and is not responsible for the app. There are no purchases to refund: Rickey is free and contains no in-app purchase.
Governing law and disputes
These terms are governed by the laws of the United Mexican States. Any dispute that cannot be resolved between us will be submitted to the competent courts of Mexico, and you and we waive any other jurisdiction that might apply by reason of our present or future domicile.
If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may still bring proceedings in your own country's courts where that law gives you the right to. Consumers in Mexico may also bring a complaint before PROFECO.
General
- If any part of these terms is found unenforceable, the rest stays in force.
- Our not enforcing a term on one occasion is not a waiver of it.
- You may not transfer your rights under this agreement without our written consent. We may transfer ours as part of a merger, acquisition or sale of assets, on notice to you.
- These terms, together with the Privacy Policy, are the whole agreement between us about the Service.
- We may update these terms. If a change is material we will give notice in the app or by email before it takes effect, and continuing to use the Service after that means you accept it.
